The plant material installed is warranted for a period of one (1) year from the date of installation (the “Warranty Period”). Subject to the following terms and conditions. This limited warranty does not relate to grading, seeding or settlement of subgrade. Seasonal flowers (perennial and annual) are not included in this warranty coverage.
Plant material covered by this limited warranty, which dies during the Warranty Period will be replaced with the plant material of like variety and original size, one time only, provided that the account is paid full per terms of the agreement. In order to insure the survival of replacement plant materials, replanting will be done only during appropriate planting seasons when weather conditions are favorable. The Warranty Period shall not be extended in the event that replacement plantings are required during the Warranty Period.
As a condition of this limited warranty, you are responsible to properly maintain the plant material during the Warranty Period. This limited warranty shall not cover the death of plant material caused by vandalism or uncontrollable acts of nature, which shall include but shall not be limited to, high winds, drought, fluids, ice, snow, and hurricane.
All warranty requests must be made in writing by submitting a warranty request form to Brothers Landscaping.
Watering is the primary concern for newly installed plant material. The amount of water is critical. It is possible to over water plants and in fact can be detrimental to their condition. The key of watering trees and shrubs is to keep the root ball and surrounding soil moist but not soggy or saturated. The way to accomplish this is to apply water so the moisture soaks in rather than running off the surface.
Guaranteed to root which takes approximately 2 weeks, as long as customer takes reasonable care in watering. New sod should be watered so root structure stays wet at all times. Watering times will vary based on weather conditions. Sod should be maintained as regular grass after 30 days which should include a regular chemical maintenance program.
Brothers Landscaping provides a 3 part warranty on all hardscape work.
WEEDS: 3 YEARS This warranty will cover weeds from growing in paver joints. This coverage is for a weed breakout, not for a handful of weeds. If Brothers Landscaping deems a failure has occurred, we will provide a one-time power washing and resanding over the 3 years. This warranty does not cover new germination from overseeding.
LABOR: 5 YEARS Brothers Landscaping stands behind our labor and craftsmanship for 5 years. If you occur any problems over that time, we will inspect services performed and provide labor to repair problem areas. This warranty does not cover failures do to conditions outside the scope of the hardscape installation.
LIFETIME: This part of the warranty is provided by the manufacturer of the products installed. Brothers provides no product warranty and consumers should check warranty specifications with manufacturers.
Brothers Landscaping recommends cleaning hardscapes with a power washer ever 2 years or as needed. It is also suggested to resand paver joints every 3 years or as needed with Enviro-Sand. Paver sealing is an option to protect the finish of the paver surface.
Mowing will begin approximately the first week of April and end late November. We will visit the property each week to cut and trim all lawn areas. If the sidewalk edging had been previously done we will continue, if not; you will be charged for a first time edging service. Edging will continue as part of your mowing service at no additional charge. We don't edge along driveways. We will clear clippings from all walks, driveways and patios. We will maintain the cut at no more than 3 inches in height, normal cutting height is 2.75 inches. Mowing services will be performed weekly. It is the customer’s responsibility to call the office a minimum of two days prior to the regular day to have services skipped. If a customer requests that the lawn not be cut for a period of time longer than seven days, there may be an additional charge for extra growth. A service fee (up to 75%) will be charged if a customer refuses services after they are started. If a sprinkler head is damaged, we reserve the right to inspect and repair damages. We will not be responsible for broken sprinkler heads that are damaged due to sprinkler malfunctions. NO CREDITS will be issued for cuts, at the end of the month. Questions about missed or skipped cuts need to be addressed to the office within 24 hours of the regular service date.
BEGINNING OF THE SEASON
If a customer does not sign-up for a clean-up, it will be understood that the customer will be taking care of this service prior to the first cutting. If the lawn clean-up is not done prior to the first cutting, then the lawn will not be serviced until clean-up is completed.
WEATHER CONDITION CLAUSE FOR LAWN CARE PROGRAMS
We will keep you informed of any modifications to this schedule. The success of this program depends on proper watering, mowing and cultural practices.
A. Removal of fallen branches from the lawn and landscaped beds.
B. The collection and removal of leaves from the property.
All shrubs, bushes and ornamental plantings will be pruned and shaped as appropriate for the plant species. Debris will be removed from the property. Trees over 15' are not included in landscape pruning.
END OF SEASON
At the end of the season when leaves start to fall and when lawns grow at a slower rate,
the contractor may vary the frequency of cutting as is deemed necessary. If a customer would like to ensure a particular cutting schedule, the customer must call to make the appropriate arrangements. The contractor will cut the lawn with leaves on it as long as there is not an over abundance of leaves at which time we reserve the right to skip service until yard is cleaned up. In towns that have leaf pickup, the leaves will be placed at the curb in a neat manner. In other towns removal of leaves may incur additional charges.
Total insect elimination is not desirable with any program because beneficial insects will be lost along with the targeted pests. Acceptable levels of activity and targeted applications combine to give enhanced plant aesthetics.
Climactic conditions, types of disease and plant materials affected will impact response. Results for difficult-to-control diseases will vary depending on environment, culture and agronomic programs used of treatment applied. Treatments for disease may include additional cost.

We are not responsible for any underground private utility damage that may occur (i.e. lighting, drainage, irrigation. etc.). Also, we will not be responsible for damage done to fences when grass is growing right up to fence and has to be trimmed with weed wacker.
IF YOU ARE NOT SATISFIED WITH THE RESULTS OF OUR SERVICE AND NOTIFY US WITHIN A REASONABLE TIME PERIOD WE WILL RETURN TO THE PROPERTY AND CORRECT THE PROBLEM FREE OF CHARGE. IF THE PROBLEM IS DUE TO A CHEMICAL APPLICATION WE WILL ANALYZE THE AREA AND MAKE SPECIFIC RECOMMENDATIONS TO REMEDY THE PROBLEM. WE WILL RETREAT THE AREA IF DEEMED NECESSARY. CHEMICAL APPLICATIONS WILL TAKE 10 TO 15 DAYS TO NOTICE RESULTS. BROTHERS RESERVES THE RIGHT TO PUT A SIGN ON PROPERTY FOR A MAXIMUM OF 2 WEEK PERIOD THAT WE WILL COME AND REMOVE.
STANDARD TERMS AND CONDITIONS
1.BROTHERS LANDSCAPING AGREES TO FURNISH LABOR AND MATERIALS AND IS AUTHORIZED BY YOU TO SERVICE THE PROPERTY AT THE ADDRESS SHOWN ON THE FRONT OF AGREEMENT ON YOUR BEHALF HAS THE AUTHORITY TO GRANT THE ACCORDANCE WITH THIS AGREEMENT.
2.BROTHERS LANDSCAPING IS NOT RESPONSIBLE FOR ANY INCIDENTAL CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OR RESULTING FROM THE PERFORMANCE OR NONPERFORMANCE OF ANY OBLIGATIONS UNDER THIS AGREEMENT.
3.ALL WARRANTIES WILL BE VOIDED IF SERVICES ARE NOT PAID IN FULL. AS AGREED NO CASH VALUE IS IMPLIED FOR WARRANTY WORK.
4.A LATE FEE OF 3% PER MONTH WILL BE CHARGED ON ANY BALANCE UNPAID OVER THIRTY (30) DAYS. A SERVICE CHARGE OF $25.00 WILL BE CHARGED FOR ANY RETURNED CHECKS. IF YOUR ACCOUNT BECOMES EXCISSIVELY DELINQUENT, SERVICE WILL BE DELAYED UNTIL PAYMENT IS RENDERED AT WHICH TIME TO OUR DISCRETION SERVICE WILL COMMENCE AGAIN. IN ADDITION WE HAVE THE RIGHT TO STOP SERVICING ANYONE WHO IS A CONTINUAL LATE PAYING CUSTOMER. SHOULD IT BECOME NECESSARY TO TAKE ACTION TO COLLECT PAYMENT DUE UNDER THIS AGREEMENT, THE CUSTOMER AGREES TO PAY ALL COSTS OF SUCH COLLECTION INCLUDING REASONABLE ATTORNEY’S FEES, COURT COLLECTION COSTS, AND/OR COLLECTING FEES (A MINIMUM OF $250.00).
5.IF ANY CONFLICTS EXISTS IN THIS AGREEMENT BETWEEN TERMS WHICH ARE PRINTED AND THOSE WHICH ARE TYPED OR WRITTEN. THE TYPED OR WRITTEN TERMS SHALL GOVERN. BROTHERS LANDSCAPING RESERVES THE RIGHT TO ADD FUEL CHARGES AS NEEDED IF NECESSARY BASED ON FUEL PRICES.
6.THIS CONTRACT AGREEMENT WILL BECOME BINDING AFTER THE THIRD BUSINESS DAY. ALL DEPOSITS ARE NON-REFUNDABLE.
